Terms of Service

1. Acceptance and Eligibility
By accessing or creating an account on Chronickel, you agree to these Terms of Service ("Terms"). You represent that you are at least 18 years old (or the legal age of majority in your jurisdiction) and fully capable of entering into binding contracts.
2. Provision of Service & Account Ownership
Chronickel grants you a limited, non-exclusive, non-transferable right to access the platform for private family archiving. You are responsible for maintaining account security and for all actions conducted through your credentials.
3. Acceptable Use Policy (AUP)
You warrant that you will not upload, share, or store content that:
- Is unlawful, defamatory, libelous, abusive, or violent.
- Involves Child Sexual Abuse Material (CSAM), child exploitation, or non-consensual sexual content.
- Infringes intellectual property, trademarks, or personal privacy rights of third parties.
- Contains malicious code, viruses, or unauthorized automated access tools.
Moderation & Takedowns: We reserve the right to screen uploads using automated tools and human reviewers. We reserve the right to suspend accounts or remove content immediately upon identifying AUP violations. Intellectual property infringement notices can be directed to support@chronickel.com.
4. Intellectual Property & Limited License
You retain 100% ownership of all intellectual property rights in your uploaded content. By uploading content, you grant Chronickel a worldwide, royalty-free, limited license solely to host, store, back up, process, and display your content to users authorized by your assigned space settings.
5. Plans, Billing, and Downgrades
- Subscription Terms: tiers, plan limits, and fee schedules are published on our Pricing page. Fees are billed in advance on a recurring basis.
- Downgrades & Cancellation: you may cancel at any time. Cancellations take effect at the conclusion of the active billing cycle. Account downgrades do not erase excess content; content remains readable and exportable, but new uploads are blocked until your content is back under the new plan's limits.
6. Termination and Account Grace Period
- Termination by You: you may terminate your account at any time by contacting support.
- Termination by Us: we may terminate or suspend access for material breach of these Terms upon 14 days' written notice, or immediately in cases of severe unlawful activity or security threats.
7. Limitation of Liability and Statutory Protections
- Statutory Rights: nothing in these terms excludes or limits liability that cannot be excluded under Singapore law, including the Consumer Protection (Fair Trading) Act (CPFTA) or Unfair Contract Terms Act (UCTA).
- Liability Cap: to the maximum extent permitted by applicable law, Chronospace Pte. Ltd. shall not be liable for indirect, punitive, special, or consequential damages. Our total aggregate liability under any claims arising out of or relating to the service shall not exceed the total fees paid by you to Chronickel in the twelve (12) months preceding the incident, or SGD 100, whichever is higher.
8. Third-Party Services
Chronickel relies on third-party providers to deliver the service, including Stripe (payment processing), Cloudflare (encrypted object storage), Neon (database hosting), Resend (transactional email delivery), OpenAI (automated content moderation), and Vercel (application hosting). These providers operate independently of Chronickel and are governed by their own terms of service.
To the maximum extent permitted by applicable law, Chronospace Pte. Ltd. is not liable for loss, damage, service interruption, or data unavailability directly caused by the acts, omissions, errors, or outages of these third-party providers, except where such liability arises from our own failure to exercise reasonable care in selecting or overseeing them. This section does not limit any statutory rights that cannot be excluded under Singapore law, as set out in Section 7.
9. Dispute Resolution and Governing Law
These Terms are governed by and construed in accordance with the laws of Singapore. Any dispute, controversy, or claim arising out of or relating to these Terms shall first be submitted to informal negotiations with Chronospace Pte. Ltd. for at least 30 days. If unresolved, disputes shall be submitted to the exclusive jurisdiction of the Courts of Singapore.
